Voilà la pétition bilingue publiée en 2007, sur PetitionOnline et que j’avais envoyée aux avocats de Fernando. Cette pétition était destinée aux avocats de Fernando qui devaient la transmettre aux membres du jury lors du prochain procès. Malheureusement, le procès n’a toujours pas eu lieu depuis.


 

Ce qu’il en est aujourd’hui : Fernando devait rencontrer son nouvel avocat à la mi-mai. Nous attendons donc le compte-rendu de cette rencontre pour savoir si une prochaine date de procès est prévue et si nous devons relancer des pétitions.

Pétition pour Fernando Eros Caro :

Nous, citoyens français, amis et supporters de Fernando Eros Caro, demandons à chaque juré de son nouveau procès, d'examiner avec la plus grande attention tous les éléments suivants :

Fernando Eros Caro, indien Yaqui âgé de 57 ans, a  été arrêté en 1980 puis condamné à mort en janvier 1982 et transféré à la prison de San Quentin en Californie dans laquelle il se trouve encore actuellement.

Durant ces 25 pénibles années passées dans le couloir de la mort, trois dates d'exécution ont été programmées.

En 2000, la Cour Suprême avait décidé d’annuler la sentence de mort pour Fernando Caro. Malgré cela, un nouveau procès aura lieu en mars 2008.

Monsieur Fernando Caro a attendu chaque jour pendant plus de 25 ans qu’une date d’exécution soit fixée. Ceci est la pire des punitions que l’on puisse infliger à un être humain.

Nous considérons que cette situation est inhumaine et intolérable et qu'elle représente une violation de la Constitution des Etats-Unis qui "interdit les châtiments cruels, toute punition cruelle ou disproportionnée".

Nous vous demandons de tenir compte du fait que Monsieur Fernando Caro a, durant toutes ces années, fait preuve d'indéniables qualités humaines et d'une grande sensibilité qu'il exprime à travers ses peintures, poèmes, écrits et correspondances qu'il entretient avec des personnes du monde entier.

Nous vous supplions de ne pas prononcer une autre condamnation à mort à l’encontre de Monsieur Fernando Eros Caro.

Mr Fernando Caro, a 57 year-old Yaqui indian, following his arrest in 1980, was sentenced to death in 1982 then transferred to St Quentin
s penitentiary on death row in California where he is still being held to this day.

During this time, his execution date has been rescheduled 3 times.

In the year 2000, the Supreme Court reversed the sentence of death penalty for Mr Fernando Caro. Despite this reversal, Mr Caro remained on death row awaiting a new trial in 2008.

So far, Mr Caro has spent 25 very long painful years on death row.

We wish you to take into account not only the decision expressed by the Supreme Court, but also the Eight Amendment of the American Constitution which clearly condemns 
"the use of cruel and unusual punishment".

During those 25 years Mr Fernando Caro has shown to possess remarkable and undeniable human qualities. He has become an accomplish artist, expressing a very deep sensibility in his paintings, writings, poetry and correspondence to people worldwide.

We hope that each of you, member of the jury, will take all those facts into account, and we are begging you not to bring another death sentence of death penalty for Mr Fernando Eros Caro.

Mr Fernando Caro was born in 1949 in a farm worker family in California. His mother was a Yaqui native and his father Aztec. Fernando was arrested in 1980 but always claimed his innocence. His trial was flawed by many irregularities and serious mistakes were made. Now, Mr Caro is waiting for a new trial in 2008.

To be on death row for 25 years must be one of the worse punishment inflicted to a human being. That is why we organize this petition and to show our support to Fernando Caro.

Fernando is a very caring person and people who know him can testify that he is a very peaceful man.

Please help Fernando Caro by signing and forwarding this petition. In the name of human dignity... thank you.

This petition is for the next jury but it will be given to Fernando's lawyers.
